Motor anti-fraud reporting: IVASS Consultation no. 2/2026 redesigns the annual report model
On 23 March 2026, IVASS opened a public consultation (Consultation no. 2/2026, closed on 22 May) on the draft Regulation redefining the annual anti-fraud report model for the motor liability (RC Auto) line, implementing Article 30, paragraph 1, of Decree-Law no. 1/2012. Once finally adopted, the Regulation will replace ISVAP Regulation no. 44 of 9 August 2012 and will move the data collection onto the Infostat platform, through the new MANFR and DANFR surveys announced in the Letter to the Market of 9 March 2026. For claims-handling functions, it is time to align data flows.
What the new model requires
The model comprises four numerical schedules — labelled MANFR — and a questionnaire. The schedules collect, broken down by province and by damage position, claims reported in proportion to risk units, claims exposed to fraud risk, claims subject to in-depth review, claims closed without follow-up due to anti-fraud activity, criminal complaints filed, and disputed (disconoscimento) claims. Two dedicated schedules cover data on the proceedings arising from criminal complaints and on contracts. The questionnaire captures the organisational structure and the procedures — including IT procedures — adopted at underwriting and at settlement.
What changes from ISVAP Regulation 44/2012
The framework is deliberately conservative, but it introduces new information on phenomena that have emerged in recent years: identity theft, fictitious vehicle registration (Article 94-bis of the Highway Code) and disputed claims. The channel also changes: reporting moves to Infostat, the platform undertakings have used since 2016 for Solvency II reporting and financial statements. IVASS notes that the new data are already available to undertakings and that the change does not entail significant additional burdens.
Who is in scope and on what deadlines
The obligation applies to undertakings authorised in Italy and to EU undertakings operating under freedom of services or establishment that are licensed for RC Auto. The report, approved by the administrative body, is transmitted within the regulatory deadlines; for EU undertakings the deadline is 31 May each year. It is a supervisory obligation in full. With the consultation closed on 22 May, the final Regulation — not yet published to date — is expected shortly, together with the technical instructions for the Infostat surveys: it is worth being prepared for the first full reporting cycle.
